These terms of use and our Privacy Policy, which is incorporated herein by reference (collectively, “Terms of Use”), govern the relationship between you and ASSIST Software and your use of any online or mobile product or service to which you have access, any product or service that requires an internet connection or ASSIST Software Account to access, install, use, or play, any ASSIST Software Account you use to access online or mobile products or services, and any ASSIST Software website, including but not limited to https://assist-software.net/ and any service accessible from an ASSIST Software webpage offered by ASSIST Software may have its own specific Terms of Use and Privacy Policy, and if you download, access, or use an ASSIST Software Service, you agree to also be bound by its specific Terms of Use and Privacy Policy.
THESE TERMS OF USE CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER, WHICH AFFECT YOUR LEGAL RIGHTS. PLEASE READ IT CAREFULLY.
YOUR ACCEPTANCE OF THESE TERMS OF USE
These Terms of Use form a legal agreement between you and ASSIST Software. When you use an ASSIST Software Service, you agree to be bound by all of the terms, conditions, and restrictions in these Terms of Use. Please read them carefully.
You acknowledge that you may access and/or download some ASSIST Software Services for free, and while there may be additional content or services available for purchase within some ASSIST Software Services (“In-App Purchases”), such In-App Purchases are entirely voluntary and not required to participate in or advance within ASSIST Software Services. You also acknowledge that you may not access and/or download other ASSIST Software Services without executing a separate agreement with ASSIST Software which may require you to pay for content or services (“Service Charges”).
By using the Services you agree to observe and be bound by this Privacy Policy and you consent to the processing, collection, use and disclosure of your information and data in accordance with its terms. Please do not use the Services if you do not agree to this Privacy Policy.
We collect information you provide us, including:

How We Use Your Information
To operate our business and personalize your game experience including to:
- Operate, improve, and develop our games and services;
- Populate online leaderboards and enable online matchmaking;
- Facilitate sharing on social networks;
- Activate or authenticate your games and save game progress and stats;
- Provide software updates;
Compliance with legal, regulatory and law enforcement requests. We cooperate with government and law enforcement officials and private parties to enforce and comply with the law. We will disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process, to protect our property and rights or the property and rights of a third party, to protect the safety of the public or any person, or to prevent or stop activity we consider to be illegal or unethical.
Website analytics. We use web analytics tools to collect information about how you interact with our website or mobile game, including what related pages you visit, how much time you spend on each page, what operating system and web browser you use and network and IP information. We use the information provided by these tools for website analytics. These tools place persistent cookies in your browser to identify you as a unique user the next time you visit our website.
Cookies. We do not use cookies for tracking purposes. You can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off all cookies. You do this through your browser settings. Since each browser is slightly different, look at your browser's Help Menu to learn the correct way to modify your cookies.
Data Use and Sharing. Information We Share with Third Parties
We use your data (username and highscore) and upload it on our server for the leaderboard. We do not share personal information that directly identifies you (such as your name, e-mail or username) with independent third parties without your consent, unless it is either required by law or we determine that disclosure is reasonably necessary to enforce our rights, property or operations or to protect our players or third parties. We may share anonymous or aggregated information, or other data that does not directly identify you, with third parties, for instance your persona on leaderboards or to show trends about use of our products.
How We Protect Your Personal Information
Security of our player’s information is a priority at ASSIST, and we take a range of measures to help protect it, including encryption of sensitive financial information.
How We Secure, Store and Retain Your Data
We follow generally accepted standards to store and protect the personal data we collect, both during transmission and once received and stored, including utilization of encryption where appropriate. ASSIST Software is ISO 27001 certified - https://assist-software.net/about-us/certifications
We keep the information we collect for an undefined period of time to allow players to access their profiles, savegames and high scores.
If a data breach occurs:
- We will notify you via email within 7 business days;
- We will notify the users via in-site notification within 7 business days;
- We will notify ANSPDCP within 72 hours.

We agree that individuals have the right to legally pursue enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires not only that individuals have enforceable rights against data users, but also that individuals have recourse to courts or government agencies to investigate and/or prosecute non-compliance by data processors.
Changes to Our Policy
We may update this policy from time to time, so please review it frequently. We'll notify you of changes via a notice on our home page (https://hooman-invaders.com) 30 (thirty) days before they go into effect. Your continued use of our products means you accept the changes. Once you accept this policy, we will not enforce future changes we deem in good faith to be material absent your express agreement to the changed terms. If you are asked to affirmatively accept material changes to this policy and you decline to do so, you may not be able to continue to use the product provided.
